Tahlequah Man Guilty of Destructive Device Possession

Jacob Austin Duncan, a 26-year-old man from Tahlequah, Oklahoma, has pleaded guilty to possession of an unregistered destructive device, a federal crime punishable by up to 10 years in prison and a $10,000 fine.

According to the United States Attorney’s Office for the Eastern District of Oklahoma, Duncan knowingly possessed a destructive device, a firearm as defined in Title 26, United States Code, Section 5845, not registered to him in the National Firearms Registration and Transfer Record.

The charges against Duncan arose from an investigation by the Cherokee County Sheriff’s Office, the Oklahoma Highway Patrol, the Oklahoma State Bureau of Investigation, and the Bureau of Alcohol, Tobacco, Firearms and Explosives.

The Honorable Steven P. Shreder, Magistrate Judge in the United States District Court for the Eastern District of Oklahoma, accepted the guilty plea and ordered the completion of a presentence report. Sentencing will be scheduled following its completion.

Duncan will remain in the custody of the United States Marshal Service pending sentencing. Assistant United States Attorney Dean Burris represented the United States in the case.

The investigation into Duncan’s possession of an unregistered destructive device has brought attention to the importance of registering firearms, particularly those classified as destructive devices.
