Fraudulent Tax Returns: A Broward County Man’s Descent into Deceit
In a shocking exposé, the Justice Department has filed a civil complaint against Eli St. Phard, a Broward County, Florida, man, alleging that he prepares income tax returns that fraudulently understate his customers’ tax liabilities. According to the complaint, St. Phard’s customers are now liable for significant tax deficiencies, penalties, and interest, totaling over $1.8 million in understatements.
The complaint, filed in the U.S. District Court for the Southern District of Florida, reveals that the Internal Revenue Service (IRS) audited 340 of the more than 3,132 returns St. Phard prepared since 2009. Shockingly, the IRS found that St. Phard understated the tax owed on all but five of the 340 returns.
The alleged scheme involves St. Phard falsely claiming deductions for business expenses his customers never incurred, fraudulently overstating his customers’ claims for refunds by falsely claiming education or fuel tax credits to which his customers are not entitled, or both. The Justice Department asserts that St. Phard’s actions are a clear example of return preparer fraud, a egregious crime that can have devastating consequences for innocent taxpayers.
Return preparer fraud is one of the IRS’s Dirty Dozen Tax Scams for 2016. To protect themselves, taxpayers are advised to choose a reputable tax preparer and be wary of suspicious activity. The IRS offers valuable tips on their website and a free directory of federal tax preparers.
The Tax Division has obtained injunctions against hundreds of unscrupulous tax preparers in the past decade. Information about these cases is available on the Justice Department website. An alphabetical listing of persons enjoined from preparing returns and promoting tax schemes can be found on this page. If you believe that one of the enjoined persons or businesses may be violating an injunction, please contact the Tax Division with details.
The case against Eli St. Phard serves as a stark reminder of the importance of integrity in the tax preparation industry. As the Justice Department continues to crack down on tax cheats, it is essential that taxpayers remain vigilant and report any suspicious activity to the authorities.
The alleged crimes committed by St. Phard have far-reaching consequences, not only for his customers but also for the integrity of the tax preparation industry as a whole. As the investigation unfolds, it remains to be seen how this case will impact the lives of those involved.
