Todd County Man Charged in Assault on Federal Officers
A 21-year-old Todd County man has been accused of assaulting two federal officers, sparking a federal investigation and possible prison time.
Alejandro Santistevan, 21, was indicted by a federal grand jury on September 9, 2020, for allegedly assaulting, resisting, and impeding a federal officer on May 18, 2020, in Todd County, South Dakota.
According to the indictment, Santistevan’s actions involved physical contact with the officers, who were employed by the Rosebud Sioux Tribe.
Santistevan appeared before U.S. Magistrate Judge Mark A. Moreno on July 16, 2021, and pleaded not guilty to the indictment.
If convicted, Santistevan faces a maximum penalty of up to 8 years in federal prison, a $250,000 fine, 3 years of supervised release, and a $100 fine to the Federal Crime Victims Fund. He may also be ordered to pay restitution.
The investigation is being conducted by the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Kirk Albertson is prosecuting the case. Santistevan was released on bond pending trial, which is set for August 31, 2021. The charges are mere accusations, and Santistevan is presumed innocent until proven guilty.
