Assault Suspect Behind Bars: Atole’s Guilty Plea to Assault with a Dangerous Weapon

ALBUQUERQUE, New Mexico – Tyson Atole, a 30-year-old Jicarilla Apache Nation member, pleaded guilty to assaulting two Native American women in New Mexico, Grimy Times has learned.

According to court documents, Atole, who resides in Dulce, N.M., attacked the women in two separate incidents, one on May 2, 2015, and another on January 28, 2016, both on the Jicarilla Apache Indian Reservation in Rio Arriba County, N.M.

Atole was arrested in February 2016 on an indictment charging him with assault with a dangerous weapon, a bottle, and assault resulting in serious bodily injury. During his guilty plea hearing, Atole admitted to assaulting a woman with a bottle on May 2, 2015, and intentionally striking another woman with his fist on January 28, 2016, causing her to sustain serious bodily injury.

The defendant was remanded into custody after entering his guilty plea and will remain detained pending his sentencing hearing, which has yet to be scheduled. At sentencing, Atole faces a maximum statutory penalty of ten years in federal prison on each of the two assault charges.

This case was investigated by the Jicarilla Apache Tribal Police Department and is being prosecuted by Assistant U.S. Attorney Joseph Spindle. The case was brought as part of the Tribal Special Assistant U.S. Attorney (Tribal SAUSA) Pilot Project in the District of New Mexico, which aims to increase the likelihood that every viable violent offense against Native American women is prosecuted in either federal court or tribal court, or both.
