SALT LAKE CITY – Two Utah men are trading sunshine for steel bars after admitting to deliberately dodging their tax obligations. Larry Oral Bosh, 46, of Nephi, and David Shawn Benson, 40, of Ivins, each received two-year federal prison sentences this week in U.S. District Court in Salt Lake City, along with a year of supervised release following their incarceration. The IRS isn’t letting this slide, and neither is the Department of Justice.

Judge Clark Waddoups handed down the sentence to Bosh on Tuesday afternoon, ordering him to also pay a hefty $563,672 in restitution to the Internal Revenue Service. Court documents reveal Bosh raked in substantial income from Evolution Developments, LLC and Clover Creek, LLC between June 2007 and October 2008. But instead of playing by the rules, he willfully failed to report that income, claiming a measly $5,502 for the 2008 tax year – a staggering underreporting of $1,732,502.

Bosh confessed, as part of a plea agreement, to preparing and filing a fraudulent 2008 tax return around April 20, 2010. The jig was up, and the bill came due. His actions left him owing the IRS that $563,672, a debt he’ll now be paying off while behind bars. This wasn’t a simple mistake; it was a calculated scheme to defraud the government.

Not far behind, Judge David Nuffer also delivered a two-year prison sentence to Benson on Tuesday, coupled with one year of supervised release. Benson’s scheme mirrors Bosh’s: substantial income earned from SHB Enterprises, LLC and Evolution Developments, LLC from June 2007 to October 2008, deliberately concealed from the IRS. He reported just $37,982 in income for 2008, underreporting a massive $1,902,109.

Like Bosh, Benson admitted to knowingly filing a false tax return on April 12, 2010, fully aware he was cheating the system. Judge Nuffer ordered Benson to fork over $610,467 in restitution to the IRS. Both men thought they could get away with it, but the long arm of the law – and the IRS Criminal Investigation division – reached them.

The investigations were spearheaded by IRS Criminal Investigation special agents and prosecuted by the U.S. Attorney’s Office in Utah. These sentences send a clear message: tax evasion is a serious crime with serious consequences.
