A former Utica tax preparer has been sentenced to probation for filing false tax returns, raking in over $100,000 in restitution from the IRS.
Dianna Nolan, 48, of Utica, New York, was sentenced to 3 years of probation in federal court in Utica for her crimes, which date back to 2014. Nolan pleaded guilty to filing false federal income tax returns, admitting to not reporting all of her income as a tax return preparer in Oneida County, New York between 2014 and 2018.
As a licensed tax preparer, Nolan claimed she failed to report all of her income on her personal tax returns for the years 2017 and 2018. But that’s not all – she also filed false returns on behalf of her clients, claiming losses from rental properties to reduce their tax liability and bilk the IRS out of thousands.
According to the U.S. Attorney’s Office for the Northern District of New York, the scheme resulted in a total of $101,636 in losses for the IRS. Nolan’s clients were left with reduced tax liabilities, while she pocketed the cash and left the IRS to foot the bill.
Nolan’s sentencing comes after a lengthy investigation by the Internal Revenue Service-Criminal Investigation (IRS-CI). The agency worked tirelessly to uncover Nolan’s scheme and bring her to justice.
Assistant U.S. Attorneys Michael F. Perry and Melissa O. Rothbart prosecuted the case, securing a guilty plea and substantial restitution for the IRS. Nolan’s sentence serves as a stark reminder of the consequences of tax fraud and the importance of accountability in the tax preparation industry.
