Lackawanna County Man Sentenced for His Role in Tax Fraud

SCRANTON, PA – Walter J. Pietralczyk, Jr., 40, of Jermyn, Pennsylvania, was sentenced yesterday in federal court for his role in a tax fraud scheme.

Pietralczyk’s wife, Danielle Ross, a Lackawanna County attorney, was also involved in the scheme. U.S. Magistrate Judge Thomas M. Blewitt ordered Pietralczyk to serve a two-year term of probation and pay restitution in the amount of $63,124.

According to United States Attorney Peter Smith, a criminal information was filed on November 5, 2013, charging Pietralczyk with one count of preparing and filing a fraudulent joint tax return on behalf of himself and his wife.

The information alleges that Pietralczyk knowingly filed a false tax return, Form 1040, that reflected income substantially less than the couple’s actual joint income for the calendar year 2009.

The restitution ordered reflects the tax loss for the calendar years 2008 through 2010.

The prosecution is the result of a joint investigation by the United States Internal Revenue Service (IRS) and the Federal Bureau of Investigation (FBI). Assistant United States Attorney Michelle Olshefski prosecuted the case.

The case serves as a reminder of the consequences of tax fraud and the importance of honest reporting to the IRS.

Pietralczyk’s sentence is a significant blow to those who would seek to cheat the system and avoid their tax obligations.
