Jaquan McIntosh, Racketeering Conspiracy and Murder, New York 2013

Jaquan McIntosh, a/k/a ‘BJ,’ has admitted to his participation in a racketeering conspiracy and the murder of 17-year-old Donville Simpson on October 5, 2013, in connection with his membership in the violent street gang ‘2Fly YGz,’ or ‘2Fly.’

McIntosh faces life imprisonment for his role in the shootout that led to Simpson’s death. The United States Attorney for the Southern District of New York, Preet Bharara, highlighted the ongoing threat of gang violence in public housing developments like Eastchester Gardens, where McIntosh and members of his gang terrorized residents.

The “2Fly” gang, a subset of the “Young Gunnaz,” operated within the confines of ECG and the surrounding area. Known for their control over the narcotics trade at the playground and apartments within ECG, they sold marijuana, crack cocaine, and other illegal substances, while storing guns to protect their business from rival gangs.

McIntosh’s arrest followed a multi-year investigation by law enforcement agencies including the NYPD’s Bronx Gang Squad, HSI, DEA, and ATF. He was one of 57 members and associates charged in an Indictment on April 27, 2016; 19 have already pleaded guilty.

U.S. Attorney Bharara commended the efforts of the NYPD, HSI, DEA, ATF, and the Bronx County District Attorney’s Office for their support in bringing McIntosh to justice. Assistant United States Attorneys Rachel Maimin, Micah W.J. Smith, Hagan Scotten, Jessica Feinstein, and Drew Johnson-Skinner are leading the prosecution in this case.

The sentencing is scheduled for next year before United States District Judge Lewis A. Kaplan.
