BREAKING: A Marion County man has been sentenced to 63 months in prison for possessing a firearm while banned from owning one. James Joshua Hardesty, 40, of Rivesville, West Virginia, was handed down the sentence on no specified date in U.S. District Court.
Hardesty was found guilty of ‘Unlawful Possession of a Firearm’ after he admitted to having a .40 caliber pistol in March 2020 in Marion County. This admission came despite being prohibited from owning a gun.
Prosecutors led by Assistant U.S. Attorney Sarah E. Wagner presented evidence that Hardesty knowingly possessed the firearm, breaching the terms of his prohibition.
The investigation into Hardesty’s activities was a joint effort between the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Fairmont Police Department.
Senior U.S. District Judge Irene M. Keeley presided over the trial and handed down the sentence. This is a stark reminder that violating firearms laws will be met with severe consequences.
Hardesty’s guilty plea in February 2021 marked the beginning of the end for the Rivesville resident. The 63-month sentence is a testament to the U.S. Attorney’s Office commitment to enforcing firearms laws and keeping our communities safe.
The sentence serves as a warning to others who may be tempted to break the law and possess firearms despite being prohibited. The Grimy Times will continue to follow this story and provide updates as more information becomes available.
