Smeltzer pleaded guilty to one count of “Aiding and Abetting the Distribution of Heroin,” a charge that carries a maximum penalty of 20 months behind bars and a fine of up to $1,000,000. The guilty plea, entered in Martinsburg, was announced by United States Attorney Bill Powell, underscoring the federal government’s continued crackdown on narcotics flowing through rural Appalachian communities.
While the statutory maximum stands, the actual sentence will be determined under the Federal Sentencing Guidelines, which weigh the seriousness of the offense and the defendant’s criminal history. The investigation was led by the Eastern Panhandle Drug and Violent Crimes Task Force, a HIDTA-funded initiative designed to combat regional narcotics networks, alongside the Berkeley County Sheriff’s Office. Special Assistant U.S. Attorney C. Lydia Lehman, who also serves with the Berkeley County Prosecuting Attorney’s Office, handled the prosecution. The case was presided over by U.S. Magistrate Judge Robert W. Trumble, who will likely forward findings to a district judge for formal sentencing in the coming months.
