Albany, NY – Marriage Scam Exposed

A 5-day trial ended with a guilty verdict for Yana Potapova, a 29-year-old Russian citizen, on charges of conspiracy to commit marriage fraud. The sentencing is set for July 10, 2018, where she may face up to 5 years in prison.

According to the evidence presented at the trial, in April 2014, Potapova entered into a sham marriage with U.S. citizen Brett Thompson in exchange for approximately $3,500. To obtain permanent residency, Potapova falsely claimed to live with Thompson at an address in Albany.

Thompson, who has already pleaded guilty to conspiracy to commit marriage fraud, awaits sentencing. This case was investigated by Homeland Security Investigations (HSI) and is being prosecuted by Assistant U.S. Attorney Emmet O’Hanlon.

The announcement was made by U.S. Attorney Grant C. Jaquith and Kevin M. Kelly, Special Agent in Charge of the Buffalo Field Office of Homeland Security Investigations (HSI). This conviction sends a strong message that such deceitful tactics will not be tolerated in our communities.

The U.S. Sentencing Guidelines, along with other factors, will determine the final sentence. A defendant’s sentence is imposed by a judge. In this case, Senior United States District Judge Thomas J. McAvoy will decide the final sentence.
