Damion Xavier Giglio, Possession of a Firearm by a Convicted Felon, Mississippi 2023

GULFPORT, MS – Damion Xavier Giglio, 39, of Saucier, Mississippi, is headed to federal prison for 27 months after pleading guilty to illegally possessing a firearm. The sentence was handed down in U.S. District Court, bringing an end to a case stemming from a February 2023 encounter with local law enforcement.

The trouble began on February 11, 2023, when Marine Resource Officers discovered Giglio trespassing on private property in Harrison County. He wasn’t just breaking property laws; he was also violating game regulations by failing to wear hunter’s orange. But the most serious charge emerged when officers discovered Giglio was a convicted felon in possession of a loaded weapon. The discovery immediately triggered a federal investigation.

According to court documents, the ATF took the lead on the case, building a solid case for prosecution. Giglio was subsequently indicted by a federal grand jury on March 21, 2023. He initially fought the charges, but ultimately admitted guilt on October 17, 2023, entering a plea of guilty to the charge of possession of a firearm by a convicted felon – a crime that carries significant penalties under federal law.

U.S. Attorney Todd W. Gee made it clear that his office takes these cases seriously. “Putting firearms in the hands of convicted felons puts our communities at risk,” Gee stated in a press release. “We will continue to work with our law enforcement partners to prosecute those who violate federal gun laws.” Special Agent in Charge Joshua Jackson of the ATF’s New Orleans Field Division echoed those sentiments, emphasizing the agency’s commitment to keeping illegal weapons off the streets.

Assistant U.S. Attorney Erica Rose skillfully prosecuted the case, presenting the evidence gathered by the ATF and securing the 27-month sentence. Giglio’s prior criminal history undoubtedly played a role in the judge’s decision, highlighting the consequences of repeated offenses. The sentence serves as a warning to others considering similar illegal activities in the Southern District of Mississippi.

Giglio will now be remanded to the custody of the Federal Bureau of Prisons to begin serving his sentence. The ATF continues to investigate illegal firearms trafficking and possession throughout the region, working closely with local, state, and federal partners to reduce gun violence and protect public safety. This case underscores the ATF’s dedication to enforcing federal firearms laws and holding offenders accountable.
