MUSKOGEE, OKLAHOMA – In a brutal turn of justice, Cody Lynn Lusk, 35, from Seattle, Washington, has been sentenced to serve a total of 114 months in federal prison for his heinous crime. The United States Attorney’s Office for the Eastern District of Oklahoma announced the sentence on Friday.
Lusk faced charges for Burglary in the First Degree and Assault of a Spouse or Intimate Partner by Strangling, Suffocating, and Attempting to Strangle and Suffocate in Indian Country. He was sentenced to 84 months for the burglary charge and an additional 30 months for the assault.
The investigation leading to Lusk’s conviction was a collaborative effort between the Federal Bureau of Investigation, the Cherokee Nation Marshal Service, and the Muskogee Police Department. On March 22, 2024, law enforcement officials caught Lusk breaking into a Muskogee apartment with the intent to harm its resident.
According to investigators, during the break-in, Lusk attempted to strangle and suffocate the victim. However, the resident managed to escape during a lull in the attack, making a distress call that led to Lusk’s arrest. The incident occurred within the Cherokee Nation Reservation in Muskogee County, Eastern District of Oklahoma.
Presiding over the hearing was Honorable Ronald A. White, Chief U.S. District Judge for the United States District Court for the Eastern District of Oklahoma. Lusk will remain in the custody of the U.S. Marshals Service until he is transported to a designated Bureau of Prisons facility to serve his non-paroleable sentence.
Assistant U.S. Attorney Morgan Muzljakovich represented the United States during the trial, ensuring that justice was served for the victim. Lusk’s case serves as a stark reminder of the dangers posed by violent criminals and the commitment of federal law enforcement to protect communities.
