Anthony Hernandez Sentenced for Gun Possession, Assaults in Albuquerque

Anthony Hernandez, a 32-year-old Albuquerque man, has been sentenced to 47 months in federal prison after being convicted of being a felon in possession of a firearm and assaulting a federal officer. The sentence follows two high-profile incidents within six months.

Hernandez’s trouble began on October 26, 2021, when he was caught with a stolen 9mm pistol following reports of gunfire outside an Albuquerque apartment complex. Witnesses identified him as the gunman.

While in pretrial detention, Hernandez escalated his violence, attacking a CoreCivic security contractor and sustaining serious injuries including a concussion and nasal fracture. He was indicted for assaulting a federal officer resulting in bodily injury.

Further investigation revealed that while in custody, Hernandez was involved in additional assaults on inmates and correctional officers, including the discovery of a homemade weapon. Contraband items like a sharpened weapon and methamphetamine were also found in his possession.

In January 2025, after a three-day trial, a federal jury convicted Hernandez of assaulting a federal officer causing bodily injury—marking his second conviction within six months. Upon release from prison, he will be subject to three years of supervised release.

U.S. Attorney Ryan Ellison and United States Marshal David Barnett announced the sentence today. The Albuquerque Police Department investigated the firearm case, while the United States Marshals Service handled the officer-assault investigation. Assistant United States Attorneys Maria Elena Stiteler and Kimberly Bell are handling the prosecution.
