Vernon Verdell Blackhorse, Abusive Sexual Contact, South Dakota 2014

January 14, 2014 – Vernon Verdell Blackhorse, a 63-year-old St. Francis man, was sentenced to 144 months in custody by U.S. District Judge Roberto A. Lange for Abusive Sexual Contact. In addition to the prison term, Blackhorse was also ordered to serve 3 years of supervised release, pay a $3,000 fine, and a $100 special assessment to the Federal Crime Victims Fund.

Blackhorse was indicted by a federal grand jury on May 15, 2013, for the crime, which he pleaded guilty to on November 6, 2013. The conviction stems from an incident that took place in Eagle Butte between May 1, 2002, and August 30, 2002. During this time, the victim, who was 11 or 12 years old at the time, was living at the home of a relative where Blackhorse was also staying.

The victim, who was sleeping on a couch, woke up when she felt Blackhorse touching her over her clothing in a sexual manner. She jumped off the couch and was able to end the sexual contact. Despite the passage of time, the victim’s courage in coming forward has led to Blackhorse’s conviction and sentencing.

This case was investigated by the Federal Bureau of Investigation and the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Marie H. Ruettgers prosecuted the case.

U.S. Attorney Brendan V. Johnson announced the sentence, stating that the victim’s bravery has brought justice to the community. ‘The victim’s willingness to come forward and speak about the abuse she suffered has sent a powerful message that we will not tolerate such behavior in our communities,’ Johnson said.

Blackhorse was immediately turned over to the custody of the U.S. Marshals Service to begin serving his sentence. The case serves as a reminder that Abusive Sexual Contact is a serious crime that will be prosecuted to the fullest extent of the law.
