A 21-year-old man from Fort Hall, Idaho, has been sentenced to 24 months in prison for a violent act that could have ended in tragedy.
Adan Diaz, a resident of Fort Hall, was sentenced to 24 months in prison for assault with a dangerous weapon, according to a recent court ruling. U.S. Attorney Wendy J. Olson announced the sentence, which also includes three years of supervised release following his prison term and a $250 restitution payment.
The sentence was handed down by Chief U.S. District Judge B. Lynn Winmill, who considered Diaz’s prior six-month jail term in the Fort Hall jail on this charge.
The crime occurred on January 28, 2012, when Diaz pointed a gun at an individual who was sitting in a vehicle near a Fort Hall residence. Diaz fired a shot that missed the individual but struck a window in the vehicle.
In an interview with Fort Hall Police, Diaz admitted that he intended to injure the victim when he pointed the gun at him. The gun, a Keltec .380 caliber handgun, was later recovered by police.
The case was investigated by the Fort Hall Police Department and the Federal Bureau of Investigation.
Diaz pleaded guilty to the indictment on February 27, 2013, and was subsequently sentenced.
