New York – In a scathing legal action, New York Attorney General Letitia James has filed suit against the owners of Kenney Apartment Complex in Newburgh, Orange County, for allowing residents to endure life-threatening conditions during the harsh winter.
The lawsuit targets persistent failures in providing consistent heat and hot water, alongside a litany of other hazards such as mold, rodent infestations, and unsafe building conditions. These conditions have been exacerbated by recent cold snaps, leaving residents with no choice but to resort to dangerous heating methods that have skyrocketed their electric bills.
Attorney General James has demanded court orders requiring immediate repairs to all violations, ensuring heat and hot water access, and providing restitution for the affected tenants. ‘It is outrageous that Kenney residents have been forced to suffer inhumane conditions while their landlords ignored their cries for help,’ James stated.
The lawsuit also highlights years of neglect, with residents reporting mold-related illnesses, doors that don’t close properly, severely damaged floors, and numerous building code violations. A resident’s refrigerator was left unrepaired despite her medical need for insulin storage, while another apartment suffered from a sewage overflow that caused extensive damage.
This lawsuit is seeking to enforce a court order mandating the owners to fix all outstanding code violations within 30 days, guaranteeing safe and livable apartments for Kenney residents. The Attorney General’s office has made it clear that they will not tolerate such neglect of human rights in affordable housing developments.
Attorney General James’ aggressive action sends a strong message to property owners that the safety and well-being of tenants are paramount, and neglecting these basic requirements will result in legal consequences.
