Letitia James, Neglect of Affordable Housing, New York 2023

New York – In a scathing indictment of the Kenney apartment complex in Newburgh, Orange County, New York Attorney General Letitia James has sued the owners and managers for allowing residents to endure intolerable winter conditions. The lawsuit charges that the complex, an affordable housing development, left its low-income tenants freezing without heat or hot water, living amidst mold, rodent infestations, and dangerous building code violations.

For years, residents of Kenney apartments have been subjected to unsafe stairways, floor holes, ceiling leaks, and more. Their cries for help have fallen on deaf ears as management failed to address the issues despite numerous calls. AG James is seeking court orders to rectify these violations and provide restitution for affected tenants.

The lawsuit highlights the severe impact of the lack of heat and hot water during the intense winter cold, with residents forced to resort to unsafe heating methods that have driven electricity bills through the roof. The conditions have led to health issues, especially for vulnerable populations such as seniors and young children.

Among the numerous violations reported are mold and mildew causing illness, improperly closing doors leading to increased heat loss, severely damaged floors, unstable stairs, sewage leaks, peeling paint, exposed wiring, and broken appliances left unfixed. One resident’s call to replace a refrigerator essential for her insulin went ignored.

This lawsuit is a powerful move by AG James to ensure that the Kenney residents receive the safe, clean, and warm homes they deserve. The court order sought would require immediate repairs, consistent heat and hot water access, and a commitment to creating a livable environment for all tenants.

Attorney General James stated, “It is outrageous that the Kenney residents have suffered in dangerous and inhumane conditions while their landlords ignored their calls for help. No one should be forced to endure a New York winter without heat or hot water. I am taking the owners of these apartments to court to get justice for the New Yorkers who have been cruelly neglected, and make sure they have a safe, clean, and warm place to live.”
