Texas Alien Sentenced for Assault
A 31-year-old man has been sentenced to 60 months in federal prison for attempting to drown a Border Patrol agent during a struggle to arrest him, announced U.S. Attorney Ryan K. Patrick.
Edgar Garrido-Miranda, a resident of Ciudad Hidalgo, Michoacan, Mexico, pleaded guilty to assaulting the agent on December 5, 2017. He was ordered to pay restitution of $4,788.79 in addition to his prison sentence.
The incident occurred on August 16, 2017, when Border Patrol agents encountered a group of undocumented aliens near the Zacate Creek area in south Laredo, Texas. Garrido-Miranda became combative when agents attempted to arrest him, and he held one of the agents underwater until a second agent came to his rescue.
The victim suffered bruises, contusions, and a throat infection as a result of the encounter. The court commended the agent’s restraint in not resorting to deadly force during the struggle.
Garrido-Miranda is expected to face deportation proceedings after serving his sentence. He has been in custody pending transfer to a U.S. Bureau of Prisons facility to be determined in the near future. The FBI conducted the investigation with the assistance of Border Patrol, and Assistant U.S. Attorney José Angel Moreno prosecuted the case.
U.S. District Judge Marina Garcia Marmolejo ordered Garrido-Miranda to prison, warning him that the situation could have had a devastating outcome, including the use of deadly force. Garrido-Miranda is not a U.S. citizen and is expected to face deportation proceedings following his sentence.
The court acknowledged the bravery of the Border Patrol agents involved in the incident, noting that the situation could have escalated into a deadly confrontation.
