Cherry Creek Man Sentenced for Sexual Abuse of a Person Incapable of Consent
Cherry Creek, SD – In a disturbing case of sexual abuse, Angelo Ashley, a 21-year-old man from Cherry Creek, South Dakota, has been sentenced to 144 months in federal prison for his heinous crime.
According to authorities, Ashley knowingly engaged in a sexual act with a minor female who was physically incapable of declining participation in and communicating an unwillingness to engage in the sexual act.
The incident occurred on or about March 26, 2016, at Cherry Creek.
Ashley was indicted by a federal grand jury on September 11, 2018, and subsequently pled guilty on January 28, 2020.
Chief Judge Roberto A. Lange, U.S. District Court, handed down the sentence on April 20, 2020.
Ashley was also ordered to pay a special assessment to the Federal Crime Victims Fund in the amount of $100 and will undergo 5 years of supervised release following his prison term.
The case was investigated by the Federal Bureau of Investigation and the Cheyenne River Sioux Tribe Law Enforcement Services, with Assistant U.S. Attorney Cameron J. Cook prosecuting the case.
Ashley was immediately remanded to the custody of the U.S. Marshals Service upon receiving his sentence.
