BOSTON, MA – A Dominican national residing in Dorchester has pleaded guilty to charges of unlawful reentry in federal court in Boston. Axel Aguasvivas-Martinez, 31, was charged with one count of unlawful reentry of a deported alien.
The offense occurred on or about November 23, 2021, when Aguasvivas-Martinez was previously removed to the Dominican Republic on January 5, 2016. He was previously charged by criminal complaint in March 2024 and was indicted on April 17, 2025.
According to the United States Attorney Leah B. Foley, the charge of unlawful reentry of a deported alien provides for a sentence of up to two years in prison, one year of supervised release, and a fine of up to $250,000.
Aguasvivas-Martinez is subject to deportation upon completion of any sentence imposed. Sentences are imposed by a federal district court judge based on the U.S. Sentencing Guidelines and statutes that govern the determination of a sentence in a criminal case.
Boston Police Commissioner Michael Cox, Patricia H. Hyde, Field Office Director, Boston, U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations, and Assistant U.S. Attorney Suzanne Sullivan Jacobus of the Major Crimes Unit made the announcement.
Aguasvivas-Martinez pleaded guilty on May 1, 2025, in federal court in Boston. U.S. District Court Judge Allison Burroughs scheduled sentencing for June 3, 2025.
The defendant’s guilty plea brings an end to the case, which had been ongoing since his initial charge in March 2024. The case highlights the importance of enforcing immigration laws and protecting national security.
