Benjamin E. Garnica, Escaping from Federal Custody, Missouri 2020

BENJAMIN GARNICA, A MAN WANTED FOR 17 MONTHS, FINALLY CAUGHT AFTER CROSSING BORDER FROM MEXICO INTO SAN DIEGO, CALIFORNIA.

Benjamin E. Garnica, 34, pleaded guilty in federal court yesterday after being caught crossing the border from Mexico into San Diego, California, following his escape from a Springfield, Missouri, halfway house 17 months ago.

Garnica was sentenced to 100 months in federal prison in 2014 after pleading guilty to his role in a conspiracy to distribute methamphetamine. His sentence was reduced to 80 months in 2017 due to changes in the federal sentencing guidelines. He was transferred from federal prison to Alpha House Residential Reentry Center in Springfield on April 19, 2018, where he was set to be discharged on October 15, 2018.

However, Garnica signed out of the halfway house on September 8, 2018, to go to work but failed to return by 6 p.m. that day. His locker and drawers were found to have been emptied of all their contents. Garnica’s location was unknown, and he was indicted by a federal grand jury and a warrant issued for his arrest on September 18, 2018.

Garnica was finally arrested in February 2020 in San Diego as he was reentering the United States from Mexico. He faces a sentence of up to five years in federal prison without parole.

The case is being prosecuted by Assistant U.S. Attorney Patrick Carney, and it was investigated by the U.S. Marshals Service. A sentencing hearing will be scheduled after the completion of a presentence investigation by the United States Probation Office.

Garnica’s escape and subsequent capture have raised concerns about the effectiveness of halfway houses and the ability of fugitives to avoid detection. The incident serves as a reminder of the importance of vigilance and cooperation between law enforcement agencies in preventing and solving crimes.
