Bid-rigging and fraud conspiracies have tainted the walls of a financial institution in New York. Former employee James L. Hertz pleaded guilty to his role in a scheme that cheated public entities out of millions.
According to court documents, Hertz worked as a vice president in the municipal derivatives group of a subsidiary of a financial institution from 1994 to 2007. During this time, he participated in a bid-rigging conspiracy from at least 2001 to 2006. Hertz and co-conspirators designated which provider would win certain investment agreements, giving the appearance of a competitive bidding process.
The scheme involved submitting intentionally losing bids to give the false appearance of competition. The bid-rigging conspiracy deprived municipal issuers of money and property, causing them to lose out on millions.
Hertz also participated in a fraud conspiracy with a broker in Minnesota from 1998 to 2006. The broker provided Hertz with information about competitors’ bids, a practice known as a ‘last look,’ which is prohibited by U.S. Treasury regulations. Hertz submitted intentionally losing bids to the broker to make it appear that his employer had competed for the agreements.
As a result of the bid manipulation, Hertz’s employer won investment agreements at artificially determined price levels. The scheme also involved misrepresenting to municipal issuers that the bidding process was in compliance with U.S. Treasury regulations.
Hertz has agreed to cooperate with the ongoing investigation. His plea agreement marks a significant blow to the financial institution and its subsidiary. The case serves as a reminder of the dangers of corruption and the importance of transparency in the financial industry.
The scandal highlights the need for stricter regulations and greater oversight to prevent such schemes from occurring in the future. As the investigation continues, it remains to be seen what other consequences will unfold for those involved.
