Bismarck Antonio Vargas, Child Pornography, Florida 2011

Bismarck Antonio Vargas, a 43-year-old resident of Homestead, Florida, has been sentenced to 24 months in prison for possessing child pornography.

According to court documents, on or about September 22, 2011, in Broward County, in the Southern District of Florida, Vargas possessed an Apple iPhone containing 67 photos depicting child pornography. Among these images were pictures of prepubescent minors. Based on a forensic examination, the images of child pornography were uploaded to the iPhone between July 26, 2011 and September 19, 2011. Vargas viewed images of minor females and saved some of the images to his cellular telephone.

Vargas previously pled guilty to one count of possession of child pornography, in violation of Title 18, United States Code, Section 2252(a)(4)(B). He was sentenced by U.S. District Judge William P. Dimitrouleas to 24 months in prison, to be followed by five years of supervised release.

Acting United States Attorney for the Southern District of Florida, Benjamin G. Greenberg, commended the investigative efforts of the FBI. This case was prosecuted by Assistant United States Attorney Joshua S. Rothstein.

The FBI’s investigation into Vargas’ activities was a result of a thorough and meticulous examination of his iPhone. The images of child pornography were discovered during the forensic examination, which revealed that they had been uploaded to the iPhone between July 26, 2011 and September 19, 2011.

Vargas’ sentence is a result of his guilty plea to one count of possession of child pornography. He will serve 24 months in prison, followed by five years of supervised release.
