John Branch, Tax Evasion, Pennsylvania 2023

Federal authorities have handed down prison sentences to a father and son duo from Warren, Pennsylvania, for violating federal tax and currency transaction laws. John Branch, 45, and Randall Branch, 65, were sentenced in federal court for their roles in a scheme to evade taxes on their oil and natural gas business.

According to the Department of Justice, United States District Judge David S. Cercone sentenced John Branch to 12 months and 1 day in jail, a $25,000 fine, and ordered to make restitution in the amount of $377,643.74. Randall Branch received a harsher sentence of 24 months in jail, a $25,000 fine, and was ordered to make restitution in the amount of $420,117.40.

The convictions stem from the father and son’s failure to file tax returns with the IRS after 1997, despite earning a combined gross income of over $6,900,000.00 from their oil and natural gas business between 2006 and 2012. John Branch was sentenced for failing to file income tax returns, while Randall Branch was sentenced for failing to file a tax return and conspiring to defraud the United States.

The evidence presented in court revealed that Randall Branch not only failed to file tax returns but also disputed his obligation to pay taxes and challenged the authority of the IRS. Additionally, he was found to have structured financial transactions in amounts less than $10,000.00 to avoid the financial threshold reporting requirements on the FinCEN Form 104, Currency Transaction Report (CTR).

Assistant United States Attorney Marshall J. Piccinini prosecuted the case on behalf of the government. Acting United States Attorney Soo C. Song commended the Internal Revenue Service, Criminal Investigation for their role in the investigation leading to the successful prosecution of the Branches.

The sentences handed down to John and Randall Branch serve as a warning to individuals and businesses who attempt to evade taxes and flout federal laws.
