Brett Dewayne Cole, Aggravated Sexual Abuse And Abusive Sexual Contact Of A Child In Indian Country, Oklahoma 2023

A federal jury in Oklahoma has convicted a McCurtain County man of Aggravated Sexual Abuse and Abusive Sexual Contact of a Child in Indian Country.

Brett Dewayne Cole, 33, of Ringold, Oklahoma, was found guilty of two counts of Aggravated Sexual Abuse in Indian Country and one count of Abusive Sexual Contact of a Child in Indian Country following a two-day trial.

The jury delivered its verdict on Tuesday, March 7, 2023, concluding a trial that began on Monday, March 6, 2023.

According to the evidence presented during the trial, Cole engaged in sexual acts with a minor victim who had not reached the age of 12 on at least two occasions from January 2019 through May 2019.

The guilty verdicts were the result of an investigation by the Federal Bureau of Investigation and the McCurtain County Sheriff’s Office.

The United States Attorney’s Office for the Eastern District of Oklahoma prosecuted the case because the victim in this case is a member of a federally-recognized Indian tribe and the crimes occurred in McCurtain County, within the boundaries of the Choctaw Nation Reservation and within the Eastern District of Oklahoma.

Cole was remanded to the custody of the United States Marshal pending the imposition of sentencing. The Honorable John F. Heil, III, U.S. District Judge in the United States District Court for the Eastern District of Oklahoma in Muskogee, presided over the trial and ordered the completion of a presentence report.
