Brewerton Man Pleads Guilty to Theft of Social Security Benefits

SYRACUSE, NEW YORK – In a shocking case of financial deception, 66-year-old Frederick L. Guth, Jr. of Brewerton, New York, has pleaded guilty to theft of Social Security retirement benefits. According to court documents, Guth admitted to receiving a total of $33,812.00 in benefits issued under the social security number and name of another person, from November 2016 until July 2018.

Guth, aware that the benefits were not his and that he was not entitled to them, spent the money despite his full knowledge of the situation. The Social Security Administration’s Office of the Inspector General and the U.S. Attorney’s Office for the Northern District of New York are investigating and prosecuting the case.

As part of his guilty plea, Guth faces up to 10 years in prison, up to 3 years of supervised release, and a fine of up to $250,000. Additionally, he has agreed to pay restitution to the Social Security Administration.

The case is a stark reminder of the importance of protecting Social Security benefits and the consequences of stealing from the system. ‘This case is a prime example of the SSA’s commitment to protecting the integrity of the Social Security program,’ said John F. Grasso, Special Agent in Charge of the Social Security Administration, Office of the Inspector General. ‘We will continue to work tirelessly to identify and prosecute individuals who engage in this type of theft.’

Guth’s sentencing is scheduled for November 30, 2021, before Senior United States District Judge Thomas J. McAvoy in Binghamton, New York. The case was investigated by the SSA Office of the Inspector General and is being prosecuted by Special Assistant U.S. Attorney Adrian S. LaRochelle.
