WILLMAR, MN – Brian Keith Kohls, 39, of Willmar is facing serious federal charges after authorities discovered he was allegedly in possession of unregistered explosives and an illegal firearm. The bust, a joint effort by multiple law enforcement agencies, brings to light a dangerous situation narrowly averted, according to investigators.
According to court documents unsealed Wednesday, on November 20, 2021, authorities found Kohls holding a short-barreled shotgun and two homemade bombs – neither of which were legally registered with the National Firearms Registration and Transfer Record. The discovery raises questions about Kohls’ intentions and the potential for a far more devastating outcome.
Adding another layer to the case, prosecutors allege Kohls is an unlawful user of controlled substances, a fact that legally prohibits him from possessing any firearms. This revelation is central to the government’s case, bolstering the argument that Kohls knowingly violated federal law and posed a risk to public safety.
Kohls has been indicted on three counts: possession of unregistered destructive devices, possession of an unregistered short-barreled shotgun, and possession of a firearm by an unlawful user of controlled substances. If convicted on all counts, he could face a maximum sentence of 10 years behind bars. He made his initial appearance in U.S. District Court yesterday before Magistrate Judge Becky R. Thorson.
The investigation was spearheaded by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), with crucial assistance from the Willmar Police Department, the Minneapolis Police Department, and the St. Cloud Police Department. The collaborative effort demonstrates the commitment of these agencies to tackling illegal weapons trafficking and ensuring community safety.
Assistant U.S. Attorney Ruth S. Shnider is leading the prosecution. While an indictment has been filed, it’s crucial to remember that Kohls is presumed innocent until proven guilty beyond a reasonable doubt in a court of law. A formal detention hearing is scheduled for October 20, 2022, where a judge will determine if Kohls will remain in custody pending trial. Grimy Times will continue to follow this developing story.
