Bucks County Summer Camp Settles Disability Discrimination Charges

In a shocking move, Briarwood Recreation, Inc., d/b/a Briarwood Day Camp, has agreed to settle allegations of disability discrimination in a shocking case that has left parents and advocates reeling.

The settlement, reached with the United States Attorney’s Office for the Eastern District of Pennsylvania, resolves a complaint filed by the parents of a young child who was denied the opportunity to participate in summer day camp programs because of his Type 1 diabetes.

The complaint, filed under Title III of the Americans with Disabilities Act (ADA), alleges that Briarwood Day Camp refused to permit the child to continue participating in the 2017 summer program and also refused to consider and provide reasonable modifications that would allow the child to attend the 2018 summer day camp program.

According to the settlement, Briarwood Recreation, Inc. will take certain remedial measures, including training its staff on the ADA and on diabetes management, developing a sample diabetes medical management plan, and designating an ADA compliance officer who will monitor compliance with the agreement.

The settlement also requires Briarwood Recreation, Inc. to pay $5,000 in compensation to the complainant and to report to the United States on its compliance annually for three years.

This case highlights the critical role that summer camps and child care programs play in the lives of parents and children, and underscores the importance of ensuring that these programs are accessible to all, regardless of disability.

Briarwood Recreation, Inc. is a private summer camp located in Furlong, PA, and has been found to have violated the Americans with Disabilities Act by denying a child the opportunity to participate in summer day camp programs because of his Type 1 diabetes.

This case serves as a reminder that disability discrimination will not be tolerated, and that those who fail to provide equal access to individuals with disabilities will be held accountable.
