New York – The Office of Special Investigation (OSI) under Attorney General Letitia James today released a report detailing the circumstances surrounding the death of Caesar Robinson, who perished on April 13, 2023, during an encounter with NYPD officers in Brooklyn. After a meticulous investigation involving body-worn and security camera footage review, interviews with involved personnel, and extensive legal analysis, OSI concluded that a prosecutor would be unable to disprove the justification for the use of deadly force by police beyond a reasonable doubt.
The tragic incident began when officers responded to a 911 call reporting an ongoing burglary at 330 Lewis Avenue. When Robinson answered the door brandishing a firearm, officers ordered him to drop his weapon. Despite these instructions, Robinson did not comply, prompting the discharge of their service weapons. The victim was rushed to the hospital but succumbed to his injuries.
Under New York’s justification laws, officers are permitted to use deadly physical force if they reasonably believe it is necessary to protect themselves from the use of deadly force.
