Ex-Colonel and Contractor Get Prison in Bribery Scheme
A former Army Colonel and a defense contractor from Augusta, Georgia, have been sentenced to prison for their roles in a bribery scheme that netted them millions of dollars in contracts from the US Army.
Calvin Devear Lawyer, 60, and Dwayne Oswald Fulton, 58, were sentenced to 60 months imprisonment each by US District Court Judge Dudley H. Bowen, Jr. for their roles in the bribery and kickback scheme. They also received a term of 3 years of supervised release and were ordered to pay fines of $100,000 and $50,000 respectively.
Lawyer, who has already returned over $5 million to American taxpayers, was also ordered to forfeit $1,273,440.00. The court approved an order of forfeiture against Fulton.
The scheme, which lasted almost a decade, involved the defendants paying cash bribes to an active-duty Colonel in exchange for steering contracts worth over $20 million to Lawyer’s company, CREC group. When law enforcement caught on, the defendants conspired to obstruct justice by creating false and fraudulent documents.
US Attorney Bobby L. Christine praised the efforts of law enforcement and the leadership at Fort Gordon, saying, ‘these prison sentences are a lamp unto the feet of would-be fraudsters who think bribery in government contracting is a get-rich scheme.’
Frank Robey, Director of the US Army Criminal Investigation Command’s Major Procurement Fraud Unit, added, ‘these sentencings send a powerful message that fraud has no place in government contracting.’
The case was investigated by a joint strike force involving agents, investigators, and auditors from the DOJ, Defense Criminal Investigative Service, Army Criminal Investigation Command (Major Procurement Fraud Unit), and the Small Business Administration.
The sentencings should serve as a stern warning to public officials and contractors doing business with the US Department of Defense, said Special Agent in Charge John F. Khin, Southeast Field Office of the DCIS.
SBA OIG’s Eastern Region Special Agent-in-Charge Kevin Kupperbusch stated, ‘corruption and willful misrepresentation of business relationships are egregious actions and bear significant consequence.’
