Capehart Convicted in Meth, Weed Sting

ALBUQUERQUE, N.M. – Daniel Capehart, a 36-year-old former New Mexico State Police officer from Bloomfield, was convicted of distributing marijuana and methamphetamine after a two-day trial in federal court.

According to court records, Capehart was found guilty of three counts of distribution of marijuana and methamphetamine, with two of the meth counts occurring within 1,000 feet of a school and playground in Farmington, New Mexico.

The investigation began on June 15, 2018, when Capehart conducted a traffic stop during which he came into contact with a 16-year-old passenger, identified as Jane Doe 1. Capehart requested Jane Doe 1’s phone number, email address, and date of birth and gave her his personal cell phone number, which she used to text him. Capehart then began texting Jane Doe 1, offering her marijuana in exchange for ‘selfies.’

Over the next two days, Capehart continued to send messages to Jane Doe 1, who was actually an undercover agent. During three recorded phone calls, Capehart discussed marijuana with the undercover agent, believing he was speaking with a 16-year-old girl. On June 23, 2018, Capehart delivered marijuana to a location near Farmington High School and Brookside Park playground, which was within 1,000 feet of a school.

Capehart was also found guilty of distributing methamphetamine within 1,000 feet of Central Primary Elementary School in Bloomfield. On June 28, 2018, Capehart conducted a traffic stop and arrested an undercover agent, who was found to have methamphetamine in their pocket. Capehart then delivered more than five grams of methamphetamine to a park in Bloomfield, which was also within 1,000 feet of a school.

Capehart faces a mandatory minimum of 5 years and up to 40 years in prison on the methamphetamine count. A sentencing date has not been scheduled. The FBI, San Juan County Sheriff’s Office, High Intensity Drug Trafficking Areas (HIDTA) Region II Narcotics Task Force, and Farmington Police Department investigated this case.
