A Timber Lake man was sentenced to 24 months in federal prison after being convicted of Assault with a Dangerous Weapon.
On March 26, 2019, U.S. District Judge Roberto A. Lange handed down the sentence to Chad Holzer, 40, following his guilty plea to the charge.
The conviction stems from an incident on September 23, 2018, when Holzer attempted to enter an individual’s home with a hatchet. The homeowner, who had heard pounding at the front door, opened it and a physical altercation ensued.
During the fight, Holzer held up the hatchet and swung it at one of the individuals, causing a laceration and swelling to their hand.
Holzer was indicted by a federal grand jury on November 14, 2018, and subsequently pleaded guilty on January 3, 2019.
This case was investigated by the Cheyenne River Sioux Tribe Law Enforcement Services, with Assistant U.S. Attorney Jay Miller prosecuting the case.
As part of his sentence, Holzer will serve 24 months in federal prison, followed by 2 years of supervised release. He was also ordered to pay a special assessment of $100 to the Federal Crime Victims Fund.
Holzer was immediately turned over to the custody of the U.S. Marshals Service.
