Child Predator Back Behind Bars: Guico-Macario Sentenced

CEDAR RAPIDS, IA – Marcos Guico-Macario, 43, is headed back to a cell after receiving a 96-day federal prison sentence for illegally slipping back into the United States after being deported. The Guatemalan national, residing in Toledo, Iowa, pleaded guilty on July 15, 2020, to one count of illegal reentry – a clear violation of federal law after a disturbing past.

Guico-Macario’s history is dark. He was initially deported in February 2003 following a May 2001 conviction in Kansas for attempted aggravated indecent liberties with a child – an aggravated felony. Despite the deportation order, he resurfaced in Iowa, brazenly using the stolen identity of a U.S. citizen to secure employment. He completed employment forms under an assumed name and Social Security number in September 2018 at a Tama, Iowa business, and continued to work under the false pretenses until his arrest on May 24, 2020.

The scheme unraveled when authorities in Tama County, Iowa, caught him providing false identification information. This wasn’t just a simple immigration violation; it was a deliberate act of fraud, compounding his prior serious offense. Assistant U.S. Attorney Daniel C. Tvedt successfully prosecuted the case, highlighting the government’s commitment to pursuing those who flout immigration laws and exploit the identities of American citizens.

U.S. District Court Judge C.J. Williams handed down the sentence in Cedar Rapids, ordering Guico-Macario to serve 96 days behind bars, followed by a three-year term of supervised release. Don’t be fooled by the relatively short sentence – there is no parole in the federal system. This means Guico-Macario will serve his time and then be under strict monitoring.

Currently, Guico-Macario is in the custody of the U.S. Marshals Service, awaiting transfer to immigration officials for deportation. This case was a joint effort, with investigators from the Department of Homeland Security, Immigration and Customs Enforcement (ICE), Enforcement and Removal Operations, building the case against him. They are sending a clear message: attempting to evade deportation and using false identities will not be tolerated.
