Derryl L. Tanner, Mortgage Fraud Scheme, Ohio 2006

STEVEN M. DETTELBACKHAD, the United States Attorney for the Northern District of Ohio, announced today that Derryl L. Tanner, 47, of Euclid, and Julie A. Becker, 39, of Cleveland, have been charged in a six-count indictment with engaging in a $2.1 million mortgage-fraud scheme related to a Westlake home.

The defendants are accused of conspiring in 2006 to defraud several lending institutions concerning transactions at 1517 Fitzroy Street. Tanner is alleged to have learned the builder was facing financial troubles and sought Becker’s assistance as a straw buyer. According to the indictment, Tanner promised Becker no down payment and cash back at closing for using her name.

Becker signed promissory notes she had no intention of repaying. She received funds in her account to qualify for a mortgage and home equity line, using false income tax returns with Tanner’s knowledge. The couple reportedly spent $250,000 from an Ohio Savings home equity line into their personal accounts.

Despite moving into the property, Tanner was unable to make monthly payments, leading to foreclosure and losses totaling approximately $670,000 to First Place, $250,000 to Ohio Savings/Amtrust, and $350,000 to National City/PNC. Assistant U.S. Attorney Mark S. Bennett is handling the prosecution of this case.

Under federal sentencing guidelines, the court will determine sentences following a review of each defendant’s criminal record, role in the offense, and violation characteristics. An indictment merely charges the defendants; they are entitled to a fair trial where guilt must be proven beyond a reasonable doubt.
