Cloudera Inc, a Santa Clara-based technology company, has been accused of intentionally discriminating against U.S. workers in favor of those with temporary visas.
The Justice Department’s Civil Rights Division filed a lawsuit against Cloudera Inc on no specific date given, alleging that the company violated the Immigration and Nationality Act (INA) by intentionally discriminating against U.S. workers in favor of those with temporary visas. The complaint was filed with the Office of the Chief Administrative Hearing Officer.
According to the complaint, Cloudera intentionally created a separate recruitment and hiring process to deter U.S. workers from applying for lucrative technology jobs. The company also allegedly failed to consider U.S. workers for these positions, which were earmarked for people with temporary employment visas.
The Division received a charge of employment discrimination from one U.S. worker who tried to apply for a job using an email account set up by Cloudera, but received a bounce-back notification.
The lawsuit alleges that Cloudera purposely failed to recruit U.S. workers in good faith when sponsoring current employees under the permanent labor certification program (PERM). The PERM program allows employers to sponsor workers for permanent resident status, only after completing recruitment of U.S. workers.
The case is part of the Justice Department’s Protecting U.S. Workers Initiative, which was relaunched in 2025. The Initiative focuses on companies that illegally discriminate against U.S. workers in favor of those with temporary employment visas.
The Justice Department’s Civil Rights Division will continue to monitor this case and take action against companies that engage in similar discriminatory practices.
