Cody Lynn Lusk, Burglary and Assault, Oklahoma 2024

Cody Lynn Lusk, a 34-year-old resident of Henryetta, Oklahoma, has pleaded guilty to one count of Burglary in the First Degree in Indian Country and one count of Assault of a Spouse, Intimate Partner, or Dating Partner by Strangling, Suffocating, and Attempting to Strangle and Suffocate in Indian Country.

The crimes, which occurred on March 22, 2024, in Muskogee County within the boundaries of the Cherokee Nation Reservation, involved Lusk breaking into a dwelling house and strangling and suffocating a dating partner.

The charges were brought as a result of an investigation by the Federal Bureau of Investigation, the Cherokee Nation Marshal Service, and the Muskogee Police Department.

Lusk will remain in the custody of the United States Marshals Service pending sentencing, which will be determined following the completion of a presentence investigation report by the Honorable D. Edward Snow, U.S. Magistrate Judge in the United States District Court for the Eastern District of Oklahoma.

Assistant U.S. Attorneys Caila M. Cleary and Morgan Muzljakovich represented the United States in this case.

The Eastern District of Oklahoma is a federal judicial district that covers the northeastern part of the state, including the Cherokee Nation Reservation.

Lusk’s guilty plea is a significant blow to the defendant and his family, who will now face the consequences of his actions.
