Couple Charged in Retaliatory Liens Scandal
A federal grand jury in Eugene, Oregon, has returned a superseding indictment against Ronald D. Joling and Dorothea Joling, charging them with one count of conspiracy to file false retaliatory liens and four counts of filing false retaliatory liens against government employees for performing their official duties.
According to the indictment, the Jolings, previously residing in Coquille, Oregon, filed false liens against multiple federal employees, including two federal judges assigned to their own criminal tax case. The liens, valued at $100.003 million each, were publicly filed with the Secretary of State for the state of California.
The Jolings were convicted in October 2014 on various criminal charges related to their federal income taxes, but failed to appear for sentencing in April 2015. They were fugitives until arrested in Flagstaff, Arizona, on October 5. The Jolings are currently in the custody of the U.S. Marshals Service.
The indictment alleges that the Jolings filed the false liens while on pretrial release in their own case, in an apparent attempt to retaliate against the federal employees who were working to prosecute them. If convicted, the Jolings each face a statutory maximum sentence of 40 years in prison and a $1 million in fines.
An indictment merely alleges that a crime has been committed, and the defendants are presumed innocent until proven guilty beyond a reasonable doubt.
The case is being investigated by the Internal Revenue Service–Criminal Investigation, and prosecuted by Senior Litigation Counsel Jen E. Ihlo and Trial Attorney Thomas A. Agnello of the Tax Division.
Arraignment in the retaliatory lien case is scheduled for November 23, before Judge Michael J. McShane, while sentencing in the criminal tax case is set for December 10, before Chief Judge Ann L. Aiken.
