A federal grand jury in Johnstown has indicted 39-year-old John D. Malden for distributing less than 28 grams of cocaine base, commonly known as ‘crack.’
According to the indictment, Malden allegedly distributed the controlled substance on April 25, 2013. If convicted, Malden faces a maximum total sentence of 20 years in prison and a fine of $1,000,000.
The investigation into Malden’s activities was conducted by the Federal Bureau of Investigation and the Cambria County Drug Task Force.
Assistant United States Attorney John J. Valkovci, Jr. is handling the prosecution of Malden on behalf of the government.
Under the Federal Sentencing Guidelines, the actual sentence imposed would be based on the seriousness of the offense and Malden’s prior criminal history, if any.
An indictment is an accusation, and Malden is presumed innocent until proven guilty in a court of law.
The case serves as a reminder of the ongoing efforts to combat drug trafficking in the Johnstown area.
