Assault on Correctional Officer Rocks California Prison
A chilling incident of violence within the walls of the Federal Correctional Institution in Herlong, California has left authorities reeling. 46-year-old Mexican national Cresencio Ochoa-Tovali has been indicted for assaulting a federal correctional officer on July 27, 2014.
According to court documents, a fight broke out in a different part of the facility, prompting a correctional officer to order a group of inmates, including Ochoa-Tovali, to sit on the ground. The inmates complied, but when the correctional officer approached Ochoa-Tovali, he suddenly stood up and struck the officer.
The case was the result of an investigation by the Federal Bureau of Investigation. Assistant United States Attorney Christiaan Highsmith is prosecuting the case.
If convicted, Ochoa-Tovali faces a maximum statutory penalty of eight years in prison and a $250,000 fine. Any sentence, however, would be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.
