SACRAMENTO, Calif. – In a shocking move, 34-year-old Damarion Nash, a Sacramento resident, has been charged with being a felon in possession of a firearm, a federal crime that carries a maximum sentence of 15 years in prison and a $250,000 fine.
According to court documents, Nash was found in possession of a loaded Colt .45 caliber handgun on January 15, 2026. This discovery is particularly disturbing given Nash’s history of prior felony convictions, including attempted robbery, criminal threats, possession of a controlled substance in prison, and being a felon in possession of a firearm and ammunition.
The investigation, led by the Sacramento Police Department with assistance from the Bureau of Alcohol, Tobacco, Firearms and Explosives, has shed light on the disturbing trend of felons in possession of firearms. Special Assistant U.S. Attorney Brad Ng is prosecuting the case, highlighting the need for stringent gun control measures to prevent such crimes from occurring.
Nash is accused of violating federal law, which prohibits felons from possessing firearms. If convicted, he will face a maximum statutory penalty of 15 years in prison and a $250,000 fine. However, any sentence will be determined by the court after consideration of applicable factors and the federal Sentencing Guidelines.
It’s worth noting that the charges against Nash are only allegations, and he is presumed innocent until proven guilty beyond a reasonable doubt. This case is part of Operation Take Back America, a nationwide initiative aimed at combating violent crime and protecting communities from perpetrators.
Operation Take Back America is a collaborative effort between law enforcement agencies and federal authorities to repel the invasion of illegal immigration, eliminate cartels and transnational criminal organizations, and protect communities from violent crime. This case is also part of the Special Assistant U.S. Attorney program, a partnership between the U.S. Attorney’s Office and local District Attorney’s Offices.
As the nation grapples with the complex issue of gun violence, cases like Nash’s serve as a stark reminder of the need for effective gun control measures and law enforcement efforts to prevent such crimes from occurring.
