BENTON, IL – Dan R. Waeckerle, Jr., a 44-year-old registered sex offender from Swansea, Illinois, has been found guilty of sickening crimes against a minor. A federal jury in St. Clair County delivered the verdict, closing a case that exposed a predatory pattern of abuse facilitated through digital communication.

Waeckerle was convicted on four counts: soliciting an obscene visual depiction of a minor, transferring obscene matter to a minor, sexual exploitation of a minor, and offense by a registered sex offender. The evidence presented at trial painted a disturbing picture of Waeckerle engaging in sexually explicit conversations with a minor via text message in July 2021. He didn’t stop there; prosecutors revealed he sent the minor a nude image, actively solicited explicit images in return, and even discussed arranging a sexual meeting.

This isn’t Waeckerle’s first brush with the law. Court records show he was previously convicted of aggravated sexual abuse against a minor in Hamilton County back in 2010. This prior conviction significantly impacts his potential sentencing, triggering a statutory minimum of 25 years in prison for the current offenses. U.S. Attorney Rachelle Aud Crowe expressed gratitude for the relentless work of the law enforcement agencies involved, stating they “pursued justice for Waeckerle’s victim and prevented other children from his abuse.”

The investigation, led by the O’Fallon Police Department and the U.S. Secret Service Central and Southern Illinois Financial and Cyber Crimes Task Force, highlights the increasingly crucial role federal agencies play in combating online exploitation. “We are thankful for the training and resources provided by our Federal partners,” said O’Fallon Police Captain Mike Mojzis, emphasizing the success of their collaborative efforts. The Secret Service, surprisingly involved in this case, reaffirmed its commitment to pursuing those who prey on children online. Stephen S. Webster, Resident Agent in Charge, stated the agency is “dedicated to holding them accountable.”

The case was part of Project Safe Childhood, a national initiative launched in 2006 by the Department of Justice to tackle the escalating epidemic of child sexual exploitation and abuse. This program pools federal, state, and local resources to identify, apprehend, and prosecute predators, and to rescue victims. Assistant U.S. Attorneys Ali Burns and Zoe Gross successfully prosecuted the case, securing the conviction.

Waeckerle’s sentencing is scheduled for May 21, 2024, at the Federal courthouse in Benton. Given his history and the severity of the charges, a lengthy prison term is almost certain. The investigation also received support from the Illinois Attorney General’s Office, Swansea Police Department and the Illinois State Police.
