A brutal attack in St. Francis, South Dakota, has landed a local man in prison. Damien Little Elk, 36, was sentenced to 37 months in custody for Assault with a Dangerous Weapon.
Little Elk’s sentence, handed down on September 8, 2014, by U.S. District Judge Roberto A. Lange, also includes 2 years of supervised release and a $100 special assessment to the Federal Crime Victims Fund.
The assault occurred on January 8, 2014, when Little Elk was drinking and arguing with the victim. In a fit of rage, he hit and kicked the victim multiple times with his shod feet, causing serious bodily injury.
Little Elk was indicted by a federal grand jury on February 12, 2014, for Assault Resulting in Serious Bodily Injury and Assault with a Dangerous Weapon. He later pleaded guilty to the Assault with a Dangerous Weapon charge on June 17, 2014.
The investigation into the assault was a joint effort between the Federal Bureau of Investigation and the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Tim Maher prosecuted the case, which was announced by U.S. Attorney Brendan V. Johnson.
Little Elk was immediately taken into custody by the U.S. Marshals Service after the sentencing.
