Justin Stone Arrow, Assault of a Minor, South Dakota 2016

GREGORY COUNTY, SD – A Sioux Falls man is headed to federal prison after a vicious attack on a 13-year-old boy left the victim requiring four stitches. United States Attorney Randolph J. Seiler announced the sentencing of Justin Stone Arrow, age 37, on November 14, 2016, following a hearing before U.S. District Judge Roberto A. Lange.

Arrow was sentenced to 15 months in federal custody, followed by a two-year period of supervised release. As part of the sentence, Arrow must also pay a $100 special assessment to the Federal Crime Victims Fund. The conviction stems from an incident that unfolded in the early hours of March 10, 2016, in the Milk’s Camp Community, Gregory County, South Dakota.

According to court documents, Arrow was drinking with his adult sister and the 13-year-old victim when an argument erupted. The situation quickly escalated, with Arrow allegedly striking the minor repeatedly in the face with his fists. The victim suffered a significant laceration under his right eye, necessitating medical attention at the Gregory County hospital. Arrow’s sister intervened, providing immediate care to the injured child.

A federal grand jury indicted Stone Arrow on April 13, 2016, on charges of Assault with a Dangerous Weapon, Assault Resulting in Substantial Bodily Injury, and Child Abuse. He ultimately pleaded guilty to the lesser charge of Assault Resulting in Substantial Bodily Injury on August 24, 2016, likely to avoid more severe penalties associated with the initial indictment. The plea deal did little to soften the blow of a conviction for violence.

The investigation into this brutal assault was conducted by the Rosebud Sioux Tribe Law Enforcement Services, demonstrating the cooperative effort between tribal and federal authorities. Assistant U.S. Attorney Carrie G. Sanderson skillfully prosecuted the case, securing the conviction and subsequent sentencing. The details revealed paint a disturbing picture of a violent outburst with a vulnerable victim.

Following the sentencing, Justin Stone Arrow was immediately taken into the custody of the U.S. Marshals Service, beginning his 15-month term. This case serves as a grim reminder of the devastating consequences of alcohol-fueled violence and the importance of protecting our children. The Grimy Times will continue to follow this case and report on similar instances of federal crime across the nation.
