Daniel Day, Illegal Possession of Machinegun, New York 2021

Grimy Times has learned that Daniel Day, a 34-year-old man from Argyle, New York, has been charged with illegal possession of a machinegun and ammunition.

According to a press release from the U.S. Attorney’s Office, Day was arrested on August 5, 2021, and charged with unlawfully possessing ammunition as a felon and illegally possessing a machinegun.

The arrest was made possible through the collaborative efforts of the FBI’s Joint Terrorism Task Force, the New York State Police, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF).

Day has a prior felony conviction for unlawfully possessing a firearm as a user of a controlled substance, which makes him ineligible to possess ammunition. He allegedly possessed the machinegun and ammunition at his residence in Argyle.

Law enforcement agents also located other firearms and ammunition at Day’s residence during the investigation. If convicted, Day faces up to 10 years in prison, a fine of up to $250,000, and a term of post-imprisonment supervised release of up to 3 years.

Day appeared before U.S. Magistrate Judge Christian F. Hummel, who ordered him detained. The case is being prosecuted by Assistant U.S. Attorneys Alexander Wentworth-Ping and Richard Belliss.

The case is part of Project Safe Neighborhoods, a program aimed at reducing violent crime through a collaborative effort between law enforcement agencies and community stakeholders.
