The station had been closed since 1994, and its underground storage tanks – filled with gasoline and other petroleum products – had been left unattended. After notifying the state of his intention to permanently close the tanks in September 1999, Axe took a shockingly reckless course of action in January 2000. Instead of properly removing and disposing of the contents, he pumped the hazardous materials directly into a sewer drain located within the station’s carwash bay.

This illegal disposal didn’t just represent a blatant disregard for environmental regulations; it created a dangerous situation. The introduction of such volatile substances into the sewer system posed an immediate explosion hazard and released toxic gases, vapors, and fumes. Critically, these pollutants were then discharged into the Dugger, Indiana Wastewater Treatment Plant, potentially overwhelming the facility and impacting the surrounding environment and community.

The Environmental Protection Agency (EPA) launched an investigation which quickly led to an indictment on March 15, 2000. Axe was charged with one count of violating 33 U.S.C. 1317(d), a section of the Clean Water Act specifically addressing toxic and pretreatment effluent standards. He subsequently pled guilty to the charge on November 7, 2000, admitting to the illegal dumping.

Sentencing and Restitution

On September 14, 2001, Axe received his sentence: five months of incarceration, followed by five months of home detention. More significantly, he was ordered to pay $38,000 in restitution to the Indiana Department of Environmental Management (IDEM) to cover the costs associated with cleaning up the contamination and repairing the damage caused by his actions.
