According to a federal indictment unsealed in the U.S. District Court for the Eastern District of Missouri, Niswonger is accused of conspiring to distribute and possess with intent to distribute controlled substances, including fentanyl and oxycodone. The charges carry a maximum sentence of life imprisonment and a fine of up to $10 million.

The investigation, led by the U.S. Drug Enforcement Administration (DEA), began in 2020 after multiple tips from concerned citizens and law enforcement agencies. Niswonger’s alleged scheme involved shipping large quantities of opioids from China and Mexico to the United States.
