Darren Bottinelli, 45, of Portland, Oregon, was sentenced Wednesday, December 14, 2016, to 46 months in federal prison for stealing $3,093,918 from employee health reimbursement accounts (HRA) managed by his company, Axis Benefit Administrators, Inc., also known as AXIS Health Partners. U.S. District Judge Robert E. Jones handed down the sentence, which includes three years of supervised release and a restitution order of $3,093,918 to be paid to victims.

Bottinelli, the sole shareholder, officer, and director of Axis, admitted in a March 2016 guilty plea to one count of theft in connection with health care. Between 2009 and 2014, he systematically looted HRA trust funds meant for medical reimbursements. The funds came from client employers across the country who relied on Axis to manage benefits for their workers—many of them low-wage, disabled, or veteran employees.

On March 19, 2014, Bottinelli abruptly shut down the Portland-based office without warning. He left no notice for employers or plan participants. Over 3,000 people were suddenly locked out of their health savings. Victims lost access to funds needed for prescriptions, surgeries, and routine care. Many reported financial ruin and emotional trauma, with some forced to delay or forgo critical medical treatment.

While workers struggled, Bottinelli lived lavishly. He funneled stolen money into private club memberships, first-class travel, high-end restaurants, and expensive wine. His actions turned health benefit accounts into personal piggy banks, all while families faced medical debt and denied care. The betrayal cut deep, especially among vulnerable populations served by clients like Goodwill Industries of South Texas, Job Squad, and Vets Securing America.

‘Mr. Bottinelli violated the trust placed in him and his company by thousands of honest, hardworking people,’ said Billy J. Williams, U.S. Attorney for the District of Oregon. ‘These individuals diligently saved a portion of their pay to provide medical care for themselves and their loved ones, only to have their money stolen by Mr. Bottinelli for his own gain.’

Federal investigators from the FBI, DOL ESBA, and USDA OIG worked together to bring Bottinelli to justice. ‘Darren Bottinelli treated these health care reimbursement accounts as his personal ATM,’ said Greg Bretzing, FBI Special Agent in Charge. ‘Today’s prison sentence is a start on making things right, but the suffering he caused these victims will live on for some time.’ The case was prosecuted by Donna Brecker Maddux, Assistant U.S. Attorney for the District of Oregon.
