CLEVELAND, OH – David Fredericy, a resident of Cleveland, Ohio, was sentenced in January 2007 to 33 months in federal prison for orchestrating a racially motivated hate crime and subsequent obstruction of justice. The case, a joint investigation by the U.S. Environmental Protection Agency (EPA) – Criminal Investigation Division (CID), the Federal Bureau of Investigation (FBI) – Hate Crime Division, and local authorities, revealed a disturbing plot to intimidate an interracial family through the deliberate contamination of their property with a highly toxic substance.
The investigation began in January 2006 after the EPA received reports of mercury being intentionally placed on the porch of a Cleveland home. Authorities quickly determined the act wasn’t accidental but a targeted attempt to harass and displace the family due to their race. Fredericy, along with co-defendant Joseph Kuzlik, was identified as being responsible. The pair allegedly hoped to create a hostile living environment, forcing the family to abandon their home.
Fredericy and Kuzlik didn’t stop at the initial act of contamination. Both men actively attempted to conceal their actions from federal investigators, providing false statements to EPA and FBI agents. This deliberate deception further compounded their crimes, leading to additional charges of making false statements, a violation of 18 U.S.C. § 1001. The EPA incurred significant costs in cleaning up the mercury contamination, posing a health risk to the residents and requiring specialized remediation efforts.
Legal Ramifications & Sentencing
Fredericy ultimately pleaded guilty to four federal felony counts: two counts of making false statements (18 U.S.C. § 1001), one count of conspiracy against the rights of citizens (18 U.S.C. § 241), and one count of interference with housing rights (42 U.S.C. § 3631). U.S. District Judge Patricia A. Gaughan, during sentencing, emphasized the severity of the crime, stating the need to send a “message loud and clear that this conduct will not be tolerated.” Fredericy received a 33-month prison sentence, followed by 36 months of probation. He was also ordered to pay $26,701 in restitution to the Ohio EPA and a $300 special assessment fee. Kuzlik received a 27-month prison sentence, along with similar restitution and probation terms.
A Pattern of Racial Intimidation
Prosecutors presented evidence demonstrating a pattern of behavior aimed at intimidating African-American residents in the neighborhood. The use of mercury, a potent neurotoxin, was a particularly egregious tactic, designed not only to frighten the family but also to potentially cause lasting harm. Assistant Attorney General Wan J. Kim of the Civil Rights Division condemned the actions as “despicable” and affirmed the Justice Department’s commitment to vigorously prosecuting such hate crimes.
Joint Law Enforcement Effort
U.S. Attorney Gregory White for the Northern District of Ohio lauded the collaborative effort between federal, state, and local law enforcement agencies. “Today’s sentence is a fitting conclusion…and demonstrates the commitment of both state and federal law enforcement authorities to protecting every citizen’s basic right to live in and enjoy his or her own home without fear of racial intimidation,” he stated. The successful prosecution of Fredericy and Kuzlik underscores the importance of interagency cooperation in combating hate crimes and ensuring equal justice under the law.
