BUFFALO, NY – David Medina, 49, a Buffalo resident, has been cuffed for possession with intent to distribute heroin. He faces a maximum penalty of 20 years and a $1,000,000 fine.
According to a criminal complaint, Medina was arrested in the City of Buffalo and found in possession of approximately 100 grams of heroin, which was intended for distribution. Assistant U.S. Attorney Mary Catherine Baumgarten is handling the case.
The defendant made an initial appearance before U.S. Magistrate Judge H. Kenneth Schroeder, Jr., and is being held pending a status conference scheduled for May 13, 2015, at 10:00 a.m.
The investigation, led by Immigration and Customs Enforcement, Homeland Security Investigations, under the direction of Acting Special Agent in Charge J. Michael Kennedy, culminated in the arrest and charges against Medina.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
